Iris Eytan fights felony charges dropped against innocent client framed by Boulder Police

Boulder DA seeks to drop charges against man shot by police in 2014

The Boulder County District Attorney’s Office is seeking to have charges dismissed against a former University of Colorado student who was shot by Boulder police during a standoff on University Hill in 2014.

Coleman Stewart, 27, was shot in May 2014 when police responded to his University Hill apartment building after a cab driver reported Stewart had skipped out on his fare. Police alleged Stewart brandished a BB gun — which they believed to be a real gun — during the incident, which prompted officers on scene to fire their weapons.

Former Boulder County District Attorney Stan Garnett later cleared the officers who fired the shots — Nicholas C. Frankenreiter, Jacob R. Vaporis and Erin P. Starks — of any wrongdoing.

A Boulder County jury later convicted Stewart of four counts of felony menacing and obstructing a police officer, but the Colorado Court of Appeals reversed the conviction because numerous judicial errors during the trial.

Online court records show that the case remained open against Stewart as of Tuesday afternoon, but his attorney, Iris Eytan, said that the judge ordered the case dismissed Tuesday night.
